EPS, OPS await Supreme Court orders

There is a conflict between O.Paneerselvam (OPS) and Edappadi K Palanisamy (EPS) due to single leadership problem in AIADMK. It culminated on July 11, 2022 in the party General Committee where the former and his supporters Vaithilingam, Manoj Pandian, J.C.T. Prabhakar and others were expelled from AIADMK.

On that day, Edappadi Palaniswami was selected as the interim general secretary by the general committee members under Article 20A section 7 of the AIADMK Act. Following this, the General Secretary election should be held in 4 months and a resolution was passed appointing Natham Viswanathan and Pollachi Jayaraman as Election Officers.

Subsequently, the single judge G. Jayachandran, who heard the case of OPS against the general meeting held on July 11, ordered that the general meeting held that day is null and void and that the status quo before June 23 should continue in the AIADMK. 

Hearing the appeal filed by Edappadi Palaniswami against this order, a bench consisting of Justices M. Duraisamy and Sundarmohan quashed the order issued by the single judge and ruled that the ADMK General Committee will go.

A bench of Supreme Court Justices M.R. Shah and Keishna Murari on the appeal filed by OPS in the Supreme Court against the judgment given by the High Court ordered to send a notice to the Edappadi side asking for an explanation on the petition filed by O. Panneerselvam.

Further, the general secretary of the party should not conduct the election before taking a final decision as the inquiry into the matter is pending; the order said and adjourned the next inquiry to November 21.

The OPS side believes that the Supreme Court has ruled in their favor and the AIADMK has been pushed into a situation where it cannot conduct the general secretary election due to the pending case in the Supreme Court. The Supreme Court has not imposed a permanent ban on the AIADMK general secretary’ election. It was said that the EPS side told the court that they will not hold this election on their own.

Political watchers believe that the final order passed by the Supreme Court on November 21, 2022 in the General Assembly issue will decide the future of the AIADMK party.
