Guv can’t dismiss minister without CM’s recommendation: SC

The Supreme Court on Friday said that the Governor does not have the power to dismiss a cabinet minister without the recommendation of the Chief Minister.
Minister Senthil Balaji was arrested on June 14 in connection with a money laundering case. After undergoing a bypass surgery, he was lodged in Puzhal prison in Chennai. Meanwhile, the state assembly had made Senthil Balaji a minister without portfolio. 
Shortly, Governor RN Ravi passed an order dismissing the minister from the cabinet only to withdraw it within hours.
While hearing a special leave petition filed by an advocate ML Ravi who assailed the Madras High Court judgement asking the Chief Minister to take a call on Balaji’s continuation in the cabinet, the apex court dismissed the 
petition.
The court orally observed that the Governor did not have powers to dismiss a minister from the cabinet without the recommendation of the Chief Minister and allowed Balaji to continue as a minister without 
portfolio.
