High Court passed its judgement favouring TTK Prestige Ltd

TTK Prestige Ltd filed a suit for injunction against Nirlon Kitchenware Private Ltd for the infringement and passing-off of its Svachh Pressure Cooker Design before the Hon'ble High Court of Madras. 

The Hon'ble High Court of Madras passed its judgement favouring TTK Prestige Ltd. The Courtacknowledged TTK Prestige Ltd's market presence and well-known trademark status for Prestige brand. The Court has granted permanent injunction against Nirlon Kitchenware, from manufacturing, selling, advertising etc., both offline and online, in any size, variant which imitates TTK Prestige Ltd’sSvachh Pressure Cooker Design Registration, as specified in the Suit.

The court has also barred the defendant from engaging in Product Passing off, requiring the surrender and destruction of materials used for manufacturing pressure cookers that imitate TTK Prestige's registered designs. Furthermore, a preliminary decree requires Nirlon Kitchenware to account for profits generated from the imitation of TTK Prestige Ltd.'s designs.
