The Collegium has recommended 70 names for the posts of High Court Judges. But the Union BJP government is silent on appointing them. As a result, the cases are pending in the High Courts without being able to complete the investigation.
Meanwhile, the Bengaluru Bar Association filed a case in the Supreme Court regarding the appointment of judges. The case was heard by a bench comprising Justices Sudanshu Dhulia and Sanjay KishanKaul.
Then the judges said, ``The Collegium has recommended 70 names for the posts of High Court Judges. But the union government is silent on appointing them. Once we know what the Union Government's opinion is on these appointments, we can take the next step.
Twenty six recommendations have been received regarding transfer of judges. Similarly, 9 persons have been nominated as High Court Judges.
But the Union Government neither accepted nor sent it back. It's silent which. cannot be taken lightly. The case was adjourned to October 9 saying,”we will question the Union government about the recommendations of the judges in this case once in 10 days”.
But the government led by Prime Minister Modi is keeping silent. Silence in the matter of the Supreme Court? In this case, it is worth noting that former Union Minister P. Chidambaram has criticized the Union Government for corrupting the Supreme Court system.
In his X social media post, he said, "Why are 70 recommendations, including the appointment of judges to the High Courts, pending with the government for several months? The government is obliged to appoint judges according to the recommendations of the collegium. The government is destroying the independence and integrity of the judiciary."
No one can deny that such trends by the Union government risk eroding the Supreme Court system. India is a democratic country with law abiding people. The Supreme Court has the highest authority to keep the law under one umbrella and uphold justice.
It is never right to shelve such Supreme Court recommendations and adopt a confrontational course with it.
What benefit will the Union Government get by obstructing people from getting justice-? The Union Government should take appropriate action by accepting the collegium recommendations of the Supreme Court and immediately sanctioning the appointments of judges.
Let's hope that the dignity of democracy will be protected!
