In the case of Mullaiperiyar, the Supreme Court has said that all the powers are vested in the Monitoring Committee of the dam.
In a case related to the safety of the Mullaiperiyar Dam, a bench headed by Supreme Court Judge AM Konwilkar issued an order increasing the powers of the Dam Monitoring Committee and strengthening the committee.
It was informed that the Mullaiperiyar Dam Monitoring Committee has all the powers till the enactment of the Dam Protection Act and once the Act comes into full force, the Committee should hand over all its powers to the concerned authority.
Further, in order to strengthen the panel, the judges ordered the addition of an expert from each of the two states to the committee, which would also include an expert from the Central Government as well.
The judges further ruled that both the states must abide by the directions of the Committee and violation of the same would be a contempt of court for which stern action would be taken.
