The bench led by Chief Justice Chandrachud of the Supreme Court currently used section 142 of the Constitution, which grants the Court absolute authority, in the Chandigarh mayor election case. The INDIA Alliance (Congress, Aam Aadmi Party) and the Bharatiya Janata Party contested the Chandigarh mayoral election. The election officer had declared the BJP candidate the victor and ruled the Aam Aadmi Party of the India Alliance's eight votes invalid.
It was purported that the poll worker had falsified the ballots in order to disqualify the Aam Aadmi Party candidates. After that, the election officer was called before the Supreme Court's judges, who interrogated him for two days. The Chief Justice's bench judges also watched the recordings of the Election Officer tampering the ballot slips. Chief Justice Chandrachud of the Supreme Court on the first day of its bench trial.noted that the case was a clear example of democracy being assassinated
Finally, in order for justice to be done, the judges declared that the Aam Aadmi Party candidate won the Chandigarh Mayoral election by using Article 142 of the Constitution - i.e. the power given by the Constitution to the Supreme Court.Social activists say that the Supreme Court has taken Article 142 in hand and upheld justice to strengthen the faith in democracy.
At the same time, one more thing should not be forgotten. It is unlikely that the election officer would have amended the ballot paper without BJP's intervention. This is a testimony to the fact that BJP will take any short cut or irregularity for its victory.
The verdict of the Supreme Court has revealed that the accusations made by the opposition leaders that the BJP will conspire to defeat the victory in the Lok Sabha elections have now come true.
Currently, the Aam Aadmi Party may lose the position of Chandigarh Mayor as three of its MLAs have joined the BJP. However, the international disgrace directed towards the Bharatiya Janata Party is indelible in the annals of Indian democracy.
The nation's Supreme Court has saved India's democracy, and for that, all Indians are raising their hands in praise. Together, let's salute too!
