During the last 2019 LokSabha elections, Rahul Gandhi, speaking at a campaign meeting in Kolar, Karnataka, made a controversial comment by stating that all those who have the name "Modi" are the same.
Gujarat BJP MLA PurneshModi filed a case in Gujarat, saying it was insulting to the entire Modi community. A Surat court convicted Rahul Gandhi in the case and sentenced him to two years in prison. With this, Rahul Gandhi lost the post of MP. A situation arose where he could not contest elections for the next 6 years after the completion of his sentence.
The Gujarat High Court dismissed Rahul Gandhi's appeal in this case. He then appealed to the Supreme Court. The appeal came up for hearing before a bench of Justices P.R Kawai, P.S Narasimha and Sanjay Kumar.
The Supreme Court heard the case and suspended the sentence awarded to Rahul Gandhi in the case. With this, Rahul Gandhi has become an MP again. It is seen as important, although this depends on the final decision.
Meanwhile, Justice Kawai has made many important points in this judgment.``Politicians who address several public meetings a day hardly remember their speeches,'' Justice Kawai observed.``When you (Surat judge) impose maximum punishment, there should be reasons for it. But the trial court did not point out any reason in this regard. A constituency that elects one person becomes unrepresented as a whole. We should take this into consideration,'' he said.
``You have affected not only the right of an individual, but the right of an entire constituency. The single judge says that he cannot grant privilege just because he is a member of Parliament. At the same time, he did not say anything about the other reasons for this punishment,'' said Justice Kawai
The single judge, who has written a 125-page judgement, gives advice on how a politician should behave in many places. However, the reason for the punishment was not explained. Justice Kawai also said that some judgments from Gujarat are interesting to read.
If the Congress's letter to the Speaker of the LokSabha is accepted immediately while the sentence imposed on Rahul Gandhi has been suspended, Rahul will go to Parliament on Monday itself.
Immediately after Rahul Gandhi was sentenced to 2 years in prison, he was disqualified from the post by the LokSabha Secretariat. As of now, it remains to be seen how many days the disqualification withdrawal order will take. Will the LokSabha Secretariat show the speed it showed when it removed him?
