Two days ago, the Allahabad High Court heard a case involving two youths who attempted to rape an 11-year-old girl. Justice Ram Manohar Narayan Mishra, who presided over the case, ruled that "grabbing a woman’s breasts and tearing her clothes does not constitute sexual assault." This shocking judgment outraged not just women but the entire country, drawing widespread condemnation.
In response, the Supreme Court stayed this controversial judgment. A bench comprising Justices P.R. Kawai and Augustine George Massey took suo motu cognizance of the case and strongly criticised the ruling. The bench stated, "The comments made in the Allahabad High Court judgment reflect the incompetence of the judge who delivered it. It is painful to express this opinion. This judgment is against the principles of law and reflects an inhuman approach."
Unjust verdicts have emerged from time to time, and the Supreme Court has repeatedly stepped in to condemn and correct them. This time too, the Supreme Court has acted swiftly, condemning the judgment and staying its execution.
The Allahabad High Court’s ruling is not only harmful to women but also an attempt to silence them. The judge failed to recognize that such a verdict would be unacceptable to any citizen, whether man or woman. There is an old saying, "One understands pain only when they experience it." If such an incident were to happen within the judge’s own family, would he still hold the same view? The Supreme Court’s strong words on the judge’s incompetence reflect the gravity of the situation.
Will such irresponsible judgements encourage more crimes against women and children? The anger of women across the country has risen in protest, and men too have joined them in solidarity.
It is not enough to simply talk about feminism and say "women are the two eyes of the country." True respect for women is shown through actions, not words. The Supreme Court’s timely intervention to stay this regressive judgment is a step towards upholding justice and protecting the dignity of women.
