Madras High Court dismisses plea by J. Deepa against Income Tax notice

Chennai, Sep. 19: The Madras High Court on Friday dismissed a petition filed by J. Deepa, niece and legal heir of late former Chief Minister J. Jayalalithaa, challenging an Income Tax Department notice demanding Rs. 36 crore.

Deepa, along with her brother J. Deepak, has been declared as one of the legal heirs of Jayalalithaa. She had moved the court questioning the tax demand raised against the estate of the late leader. The petition came up for hearing before Justice C. Saravanan.

During the hearing, the Income Tax Department informed the court that a revised notice had been issued, reducing Jayalalithaa’s tax liability from Rs. 36 crore to Rs. 13 crore.

Recording the submission, Justice Saravanan dismissed the plea, observing that the challenge to the earlier demand had become infructuous. However, the court clarified that Deepa could pursue alternative legal remedies in respect of the revised demand notice.

The dismissal effectively means that the fresh demand of Rs. 13 crore will stand unless challenged separately.
